Enrollment in the Program
To begin the enrollment process, you must submit the affiliate application. The
program application can be found at the link at the bottom of this page. You
must read, understand and accept this agreement. We will evaluate your
application in good faith and will notify you of your acceptance or rejection.
We may reject your application if we determine (in our sole discretion) that
your site is unsuitable for the Program. Your site may not contain sexually
explicit materials, promote violence, violate intellectual property rights,
promote discrimination, or promote any illegal activity.
Referral Fees
Financial Software Solutions will pay to the affiliate the fee specified in the
affiliate fee schedule. Fees are only calculated and paid on the product price
and excludes shipping and taxes (when applicable). Fees are only payable on
sales that are identified with an affiliate ID. When a customer visits our site
through an affiliate link, a cookie is placed on the customer’s computer so
that if the customer does not make a purchase on the first visit to the site,
but returns within 1 year and makes a purchase you will still be paid the
affiliate fee.
Referral Fee Schedule
Financial Solutions will pay you referral fees with one of two options. You may
select to either be paid by check on a calendar quarter basis, or by Paypal on
a monthly basis. Checks - Within 45 days following the end of each quarter, we
will send you a check for the referral fees earned on products that were sold
during that calendar quarter less any taxes that we are required by law to
withhold. However, if the fees payable to you for any quarter are less than
($25.00), we will hold those fees until the total amount due is at least
($25.00) Paypal – Within 45 days following the end of each month we will send
you a payment for referral fees earned on products that were sold during that
calendar quarter less any taxes that we are required by law to withhold. Any
applicable fees due to Paypal will be deducted from your payment by Paypal. If
a product that generated a referral fee is returned or cancelled, we will
deduct the corresponding fee from your next quarterly payment. If there is no
subsequent payment, we will send you a bill for the cancelled referral fee for
Order Processing
Financial Software Solutions will process the orders of customers. We reserve
the right to reject orders that do not comply with any requirements that we
periodically may establish. We also reserve the right to provide refunds at any
time and for any reason including refunds beyond the 30 day money back
guarantee.
Identifying Yourself as a Financial Software Solutions Affiliate Member
Links to your our website must be identified as a Affiliate Member. You can use
one of the approved logos or the phrase “In association with Financial Software
Solutions” or “In association with Debtaccelerator.com”. Other phrases may be
used with prior approval as long as they identify you as a program member.
Direct Links from Pay Per click advertising (such as Google or Overture) may be
used, but must have the word affiliate or AFF in the text of the link. We may
modify the text or graphic image of the logos from time to time.
Terms of the Agreements
The terms of this Agreement will begin upon our acceptance of your affiliate
application and will end when terminated by either party. Either party may
terminate this agreement at any time, with or without cause, by giving the
other party written notice of termination. Referral fees will only be paid on
sales during the term of this Agreement, and fees earned through the date of
termination will remain payable only if the related orders are not cancelled or
returned. We may withhold your final payment for 30 days after the last
transaction. This agreement may be modified at any time at Financial Software
Solutions sole discretion. An email or posting of a change shall be considered
sufficient notice to you of a modification of the terms and conditions of this
agreement.
Responsibility and Liability
You will be solely responsible for the operation and maintenance of your site
and all materials that appear on your site. You are responsible for the
technical operation of your site and equipment. You are also responsible for
ensuring that materials posted on your site do not infringe or violate and
third party rights such as copyrights, trademarks or other rights. You will be
responsible to comply with all laws (Federal, State or otherwise) in regard to
marketing email including all anti-spam laws. You may not make unsubstantiated
product claims about Financial Software Solutions products. We will not be
liable for any indirect or consequential damages, including loss of revenue, or
loss of data, arising in connection with this agreement. Further, our aggregate
liability with respect to this agreement shall not exceed the total referral
fees paid or payable to you under this agreement Financial Software Solutions
and Affiliate are independent contractors and neither party is the legal
representative, agent, employee, or partner of the other party for any purpose.
Neither party may create obligations of the other party of any kind
Indemnification
You agree to defend, indemnify and hold harmless Financial Software Solutions
and its employees from and against any claims actions or demands without
limitation including reasonable legal and accounting fees resulting from your
use of the material or breach of the terms of this agreement or inaccuracy of
information or quality of the affiliate program.
Disclaimer
We make no warranties express or implied with respect to the program. We make
no representation that the operation of our site will be error free or
uninterrupted.
Jurisdiction
This agreement will be enforced in accordance with the laws of the State of
Utah. Any action to enforce this agreement shall be brought in federal or state
courts located in Salt Lake City, Utah
